Green Motion Italy Rental Terms for travel between 01-May-2018 and 31-Dec-2024

Pricing: Pricing is quoted on a ‘per day’ basis (24-hour period). The rates include TPL insurance, Collision
Damage Waiver (CDW), Theft and fire protection Waiver (THW), Italian value added tax (VAT), road taxes,
airport fees and road assistance. Rates shown on www.greenmotion.it and www.greenmotion.com include
the Young Driver surcharge when applied. Drivers signing the rental agreement on this basis accept full
liability. Reduction or exclusion of collision damage responsibility is possible with KDW and SKW. Reduction
or exclusion of theft and fire responsibility is possible with TPW and STW if not differently specified. The
waiver clause may not be applied in Calabria, Sicilia, Puglia and Campania territories (please check with the
rental station). Rental Stations (Bergamo Airport, Milano Railway Station, Milano Malpensa Airport and
Venice locations) located in areas where the legislation forces to drive with winter tyres\snow chains include
winter equipment (winter tyres or snow chains) in the rate during the validity of the legislation. In all other
Rental Stations snow chains can be purchased as additional extras on request.


Vehicle Categories/Groups: Our vehicles are classified into Groups and identified by Categories. Groups
belong to different Categories and are codified by the international ACRISS Codes.
Reservations are confirmed for a Group and not a particular Model. A Group represents different Models
which are similar in terms of basic characteristics. Vehicles shown in any documentation or website are purely
indicative and can be assigned accordingly to the referring Group or substituted with Groups of the same
Category or upgraded ones, at the discretion of Green Motion Italia.
We may be unable to guarantee a particular Make/Model or fuel type of Vehicle, if not expressly specified by
the booked Group.
A request by the Customer of an upper category Vehicle determines the charge of the difference between the
two Categories (Upgrade).
A request by the Customer of a different Group from the one booked may be considered an Upgrade if the
characteristics of the Vehicle, specified by the ACRISS Code, differ in terms of dimensions, comfort and quality.


Voucher
A copy of your voucher must be produced upon arrival at the rental desk. Failure to present the voucher
means the car rental agent may charge you at the local rates. Please note: We are not responsible for
overcharges on rentals where the voucher was not presented to the local agent on collection of the vehicle.
If you do not present the required documents, the documentation is not valid or you do not have enough
funds on your credit card, the car rental agent may refuse to release the vehicle and no funds will be
reimbursed


Mileage: Unlimited mileage allowance except where differently specified. In case of limited mileage 100 km
per day maximum mileage allowance. Excess mileage is charged at 37 cent (€) per km VAT included


Opening Hours: Please see the Green Motion locations list for local opening hours. Some local holiday
variations may apply. Please always check before with specific local office. Locations may be closed for pickups
and returns on Country’s or local public holidays. Please check at the moment of booking.


Out of hours service: If an out of hours service is available then rentals will attract a €61 VAT included charge
payable on collection. The out of hours service may be provided by external personnel authorized by Green
Motion.
Out of hours requests are treated strictly as on request and cannot be guarantee. An out of hours service after
midnight may attract a higher fee or may not be allowable, in any case this additional service must be agreed
locally. Not all locations offer out of hours returns and a 24 hours service should not be assumed where out
of hours service is offered. Please refer to the Locations List for more details.
If the out of hours service is used, the report on the state of the vehicle and on possible damages detected at
the end of the rental will be drawn up by the operator at the time of examination of the vehicle at a time after
the release of the same. In particular, in case of out of hours drop-off, where there have been damages to the
vehicle, the Customer must report them by filling out the CAI form that is placed in the Vehicle. Depending
on the systems available and the indications received from the operator, this document must be left in the
vehicle or inserted, together with the keys, in the appropriate key box provided for this purpose.
It is understood, however, that the rental will not be concluded when the keys are inserted in the key box.
The vehicle will remain parked in the place where it was dropped off until the rental office opens, only then
the Vehicle will be inspected and the rental will end. Since the vehicle will only be inspected when the office
is opened, it is recommended to take photos of the vehicle in order to maintain evidence of the state of the
vehicle at the time it was left. Once the vehicle has been inspected, the rental station will inform the Customer
of the vehicle restitution as well as any possible damage and related charge.


VAT: 22% VAT is included in all rates (if applicable), except for the amounts defined as “penalties” and for the
Pre-Authorization.


Method of payment: the rental can be paid online or on arrival, according to the booking method used. All
extras (insurances included) are to be paid on arrival. Different methods of payment can be used, please verify
at the moment of purchase.
In the event that a booking has been pre-paid on a broker, aggregator, travel agent, on line travel agent or
booking web platform in general through which Green Motion offers its services, Green Motion is not
responsible for losses or damages caused to the customer subsequently to the abovementioned subjects’
non-payment of the rental service. The Customer is therefore required to pay to Green Motion the amount
of the rental, in the event that Green Motion has honoured the rental service but has not been paid for it by
the abovementioned subjects, through a charge to the customer’s credit card utilized for the rental, that can
be done also successively to the end of the invoiced rental. In the event that a customer fails to present a
valid credit card or there is a lack of sufficient funds available on the credit card, the car rental agent may
refuse the release of the vehicle. In these instances, no funds paid will be reimbursed.


Security Deposit: when collecting the vehicle the driver will be required to leave a security deposit to cover
the amount of the excess. This will be done using the driver’s Credit Card through Pre-Authorization amount
between € 300 and € 2.000 (VAT exempt), depending on the vehicle category rented. Credit card only is
accepted for pre-authorization. Cards must be in the driver’s name. Some types of credit cards may not be
accepted, please verify locally. The amount required will be the amount of the rental plus the preauthorization required according to the vehicle category and damage and theft and fire excess. Cash deposits
or payments are accepted only with a credit card guarantee. The rental station could refuse the payment with
debit, prepaid or electron credit card. In the event that the rental station accepts Electron, prepaid or debit
cards, the service will be charged for an amount of € 61 (including VAT). In case of amount not covered the
customer is obliged to give a second credit card, otherwise the location could refuse the rental. Some
categories may require two credit cards. Please apply locally for confirmation. For INTERMEDIATE and
MINIVAN vehicles, two credit cards in the driver’s name or a qualified credit card in the driver’s name may be
required; if not provided, the location reserves the right to refuse the rental.


Responsibility towards third parties (RCA): the insurance cover of the vehicle, according to the local law,
includes the responsibility towards third parties, for the maximum amounts specified by the local rental
station.


Driver accident (PAI): the local law will be applied. Where available, this additional service may be purchased
with specific related details (limits and deductibles) to be checked at the local rental station. Please check if
the location offers this service.


Accident report: the customer has to communicate each road accident or damage caused to the vehicle to
the rental station where the vehicle has been rented by email or by fax within 12 hours using the form named
CAI held within vehicle’s documentation. The customer acknowledges that the omission or delay of such
communication can cause a material damage to Green Motion, with the consequent charge of a penalty to
the customer equal to excess amount. In case of accident, regardless of the responsibility, an administrative
fee equal to € 61 VAT included will be charged to the customer for the management of the procedure.
In the event that an accident involves Third Parties, the Customer is obliged to fill in and sign the Accident
Report available at the local rental station, to request the intervention of the nearest Police Authority and to
use the CAI form held within vehicle’s documentation. To avoid possible mistakes or revocation, at the end of
each rental the Green Motion staff will request a declaration on accidents occurred during the rental. In case
the driver provides untruthful declarations or fails to provide all of the above-mentioned documents, Green
Motion reserves the right to apply a penalty of € 500 (VAT exempt). In case of serious active claims that
generate a loss for the local rental station, the station is authorized to recover the difference between the
actual expense incurred and the recognized value for the active claim.


Collision Damage Waiver (CDW): Our standard excesses are shown below along with the pre-authorization
required by credit card that must be in the driver’s name. Our excess excludes damage to the wheels, tyres,
glass, roof, underneath, interiors and chassis of the vehicle. Other exclusions apply. Please refer to rental
station for more details. Locations reserve the right to request a higher pre-authorization based on the
vehicle’s category.

Kasko Damage, Theft and Fire Protection Waiver (KDTPW): the combined purchase of services KDW and
TPW reduces the liability for damage, theft and fire through the payment of a daily amount as defined by the
table below. Customers remain liable for damages to wheels, tyres, glass, roof, underneath, interiors and
chassis as well as damages resulting from the negligence of the Customer, such as cigarette burns, etc. The
services may not cover the vehicle in case of events occurring in Calabria, Sicilia, Puglia and Campania
territories.

Young drivers will not be offered reduction and/or exclusion packages.
Green Motion suggests to park vehicles in protected parking area.
In the event of theft or embezzlement and following finding of the Vehicle, the amount due will be determined by
applying the daily rental rate until the date of release and return of the Vehicle plus the compensation for any damage
suffered and transport costs of the Vehicle.


Minimum Age: Minimum age is the age required for driving a vehicle which belongs to a certain category
without being charged the “Young Driver” surcharge, which amounts to €19 VAT included per day. For
bookings made on www.greenmotion.it and www.greenmotion.com the Young Driver surcharge is included
in the final rate. Please refer to the chart

For Mini/Economy and Compact Categories the minimum age is 25 and the Young Driver Surcharge applies
from 21 to 24 years old.
For the Intermediate Category the minimum age is 27 and the Young Driver Surcharge applies from 25 to 26
years old.
For the Minivan Category the minimum age is 30 and the Young Driver Surcharge applies from 27 to 29 years
old.
Minimum age to hire a vehicle is in any case 21, exceptions to verify with the rental station may apply. A
driving license valid almost two years is always required.
It is not allowed to hire a vehicle of a certain category if the Customer is younger than both the minimum age
and the Young Driver Surcharge age. The rental station may refuse the rental to a Customer younger than the
minimum age.


Maximum Age: 75 years old.
It is possible to rent up to 80 years old with the Senior Driver surcharge. The service costs 25€ VAT included
for each day of rental. The rental station reserves the right to refuse the rental to customers above 80 years
old. Please apply locally for confirmation.


Driving License and Identification Requirements: A full Italian driving license or international equivalent is
required. The driving license must be written in readable Roman letters and Extra-EU citizens also have to show
an International Driving License, or equivalent documentation valid in Italy, as provided by the law. Exclusions
may apply with regards to serious traffic violation or penalty points, and the rental can be refused. Any driver
must produce a valid, original copy of their driving license including photo ID. In addition, the main driver must
produce one or two valid credit cards (in customer’s name and current address) for the pre-authorization of
deposit. The customer (main driver and any additional driver/s) may also be required to provide secondary
photographic identification (passport) and proof of real address of residence. Overseas customers (for those
visiting the Italy) may be required to provide details of their residency while in Italy. In the event that a license
holder cannot produce the valid documentation, Green Motion can refuse the rental and charge a €40 fee (VAT
exempt)


Fines, Penalties and Administration Charges: It is the responsibility of each hirer to cover the cost of any
parking fines and traffic violations. When fines or traffic violations occur and a Green Motion location is
involved in administering the charge then the customer will be charged for the amount of the fine/penalty (if
the fine/penalty is not notifiable to the customer) plus an administration fee €61 VAT Included for the
management of the procedure. In the event that Green Motion receives more than one fine related to the
same rental, the customer will be charged an administration fee for each fine.
Green Motion has the faculty to recharge this amount on the credit card used to guarantee the rental in a
time of 360 days.

All extra items must be installed by the customer who takes up full responsibility.
In case of theft, fire or damage to the Nav/Gps an amount of € 150 (VAT exempt) will be charged to the
customer.
In case of abnormal uncleanness or damage to the Baby/Child Seat an amount of € 30 (VAT exempt) will be
charged to the customer.
In the event that the snow chains are not returned or are damaged (even a single piece) an amount of € 61
(VAT exempt) will be charged to the customer. As for the additional driving, if upon return of the vehicle the
presence of a driver other than that (or those) who has (or have) signed the contract is ascertained, a penalty
equal to an amount of € 61 (VAT exempt) will be charged. In the event of a claim or other events verified with
a driver not authorized by the rental contract, any reduction / exclusion of liability will expire.


One Way Rentals: The One Way is possible only with the authorization from the pick-up rental station. An
additional fee for One Way rentals is chargeable. Please contact the pick-up rental station to check if the One
Way is possible and to check the fee to be paid at the counter. In case of non-authorized One Way rental a
penalty of €244 + €1,71/km (VAT exempt) for the vehicle pick-up will be applicable.


Rental Extensions: Please note that it may not always be possible for the hiring branch to extend the hire.
Where the branch agrees to extend the hire, the rental will be charged at the prevailing rate which may be
higher or lower than the original booking rate.


Non-authorized rental extension: A penalty above the rental charge will be applied

Overseas Use: Green Motion vehicles can only be used in Italy if not authorized by the local rental station.
According to Green Card local rental stations can allow to cross the borders and use the vehicle in definite
Countries. It is the Customer’s precise responsibility, where he/she drives the vehicle abroad, to know and
respect the traffic regulations of the country in which he/she drives.
In case of unauthorized border crossing, the Customer will be charge a fee of € 61 (VAT exempt).


Delivery and Collection: A delivery and collection service may be available within normal opening hours.
Charges of €24,40 VAT included in the urban area will apply + €1,71 per km VAT Included out of the urban
area. Please contact the location for details.
In the event of Customer who asks for assistance on-site where he is stationing for reasons relative to his
responsibility (and in any case not covered by the road assistance) the Rental Station that is available to this
type of service (“Exceptional assistance on-site”) will charge an amount corresponding to the "Delivery and
Collection" fees.


Pick-up delay: the customer’s reservation will be valid up to two and a half (2,5) hours after the reservation
start time exclusively within the rental station opening hours. A reservation will be classed as a no show two
and a half hours after the reservation start time unless contact is made by the customer to the branch directly.
If a valid flight number or valid telephone number is provided, the location will make every reasonable effort
to contact the customer prior to allocating the vehicle to another reservation. In the event that the customer’s
delay is within two and a half hours from the reservation start time but out of the rental station opening
hours, the rental will be made only if the rental station has been advised and an out of hour service has been
arranged (see specific paragraph).
A no show will be treated as a new booking and only serviced if a vehicle is available and the location is open.
Flight diversions will be treated as a no show at the original location and a booking cannot be assumed to be
transferred.


Hand-over delay: a maximum one hour margin is leaved for the restitution of the vehicle, with the charge of
one day of rental fee in case of further delay at the public tariffs existing at the date of restitution.


Lost Keys: Green Motion will charge an amount of € 250 (VAT exempt) if keys are lost or damaged. Please
note that if a vehicle is stolen and keys are not returned to the rental location the hirer will be deemed
negligent and insurance is deemed void. Lost keys are deemed as negligence and are not covered under the
insurance excess or risk reduction packages. Drivers will be liable for all costs relating recovery, loss of use
and repair. The customer is liable for the whole amount value of the vehicle. Please ask to the location.


Fuel Policy: Vehicles are supplied with Full to Full tank option if not differently specified. In case of F/F, the
amount of €32 VAT included will be charged as refueling service in case of missing fuel. Hirers are
recommended to return the car with the full fuel to avoid charges. The missing fuel will charged as indicated
by each rental station. In case of Full to Empty the fuel tank amount will be charged at the counter at the
rental start according to the rates available at the rental counter. No refunds will be given for fuel not utilized.


Roadside Assistance: Breakdown cover is included in our rates. Relevant contact details and roadside
assistance procedures will be shown at local rental station and in the car documentation. Please check prior
to the commencement of the hire and anyway available inside the car documentation. Dependent on the
circumstances and where the breakdown will take place we reserve the right not to provide a replacement
vehicle.


No Smoking Policy: All vehicles are smoke free. A valeting fee may be applied to rectify any soiling due to
smoking. The minimum fee will be €61 (VAT exempt) as penalty.


Animals in our vehicles: We request no animals are transported in our vehicles unless contained. A valeting
fee may be applied to rectify any soiling due to animal transportation. The minimum fee will be €61 (VAT
exempt) as penalty. Some rental stations can provide the dog carrier, free of charge or fixed rate (check
availability and any costs at the rental station). In any case, a penalty of € 10 (VAT exempt) is required for
extraordinary cleaning if returned dirty and € 30 (VAT exempt) in case of damage.


Valeting: In the event that a vehicle is returned in an unclean condition (internally and externally) and requires
more than our standard clean, a valeting charge, of € 97,60 (VAT exempt) will apply as penalty.


Vehicle Condition: Vehicles must be returned to the location/drop off point in the same condition as when it
was picked up/delivered. Normal wear and tear is acceptable however excessive staining/damage (internal
and external) will be charged for at our valet rates (for cleaning) and at the prevailing rate for damage repair
as detailed in the notes section. It is the responsibility of the customer to ensure that the vehicle is thoroughly
checked prior to taking custody of the vehicle. Whilst in charge of the vehicle the customer accepts
responsibility for maintaining the roadworthiness of the vehicle and agrees to take remedial action to avoid
unnecessary cost/damage. This will include maintaining oil levels, tyre pressures and other common sense
actions to maintain the vehicle if before authorized. Costs will generally be covered only if it’s authorized in
advance from the rental station.
In the event that the vehicle is returned in conditions that do not allow to determine if there are new damages,
Green Motion reserves the right to inspect the vehicle after the cleaning and to charge any new damage
found.


Complaints
All complaints should be made in writing either via email to ics@cs.greenmotion.com or through our Online
Contact Form found on our Contact Us page (https://greenmotion.com/contact) within 30 days from the last
day of your rental. Whilst we do try to resolve all cases brought to our attention, those raised after this period
will not be considered. If at any point during the investigation process communication ceases for a period of
more than 30 days, the case will be considered closed and no further action will be taken.


Cancellation Policy: Cancellation of your reservation should be made in writing, fax or e-mail at least 24 hours
prior to the start of your rental. Please note that telephone cancellations will not be accepted.


Cancellation Administration Charge: if a reservation is not collected or not cancelled in advance of the start
time then Green Motion will levy a charge.
For fully pre-paid reservations made on greenmotion.com or greenmotion.it, the amount due for noshow/cancellations will be calculated in line with the below:
• 7 or more days before start date: €15
• 3-6 days before start date: 50%
• 2 days before start date: 75%
• 0-1 days before start date: 100%
The notice period is based on a day being a 24 hour period, up to the start time, not a calendar day.


Amendments: Reservation amendments must be requested in writing, fax or email at least 24 hours prior to
the start of your rental. Please note that telephone amendments will not be accepted. An amendment request
is not assured and amendments will be treated as a new booking.
No refunds will be given for rentals ended early, late collections, no shows or cancellations made after the
rental start date, even if cancellation protection is taken.


Late Returns
A vehicle is hired for a contracted period as detailed on the rental agreement. The return day and time as
selected by the customer at the time of booking will be enforced regardless of delayed pickup time. If the
vehicle is returned outside the grace period, there will be a charge of an additional day or a late fee.

Some of our vehicles contain tracking devices which will be used in accordance with our data protection policy.


GDPR
All information relating to privacy and data protection when using a Green Motion service will be contained

General Terms
All bookings are subject to our terms and conditions.
Green Motion Limited cannot accept liability for any charges incurred on documentation signed for and
accepted locally.
Green Motion Limited will not be held responsible for anyone driving under the influence of alcohol or drugs
causing wilful damage, off road driving or driving without due care and attention. The customer will accept
responsibility in respect of such claims. This list is not exclusive.
When comprehensive insurance is taken out it is to provide the customer with entitlement to drive and covers
the vehicle in the event of an accident. In the case where a customer is found negligent Green Motion Limited
and its locations reserve the right to pursue the customer for the recovery of all losses incurred.
Calls to Green Motion may be recorded.

The rates on this website are often heavily discounted. This is due to our negotiated rates and bulk buying power. On very rare occasions, a rate may be displayed incorrectly due to our, or a vehicle supplier's error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.

Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier's rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Vehicle capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund Policy
In the event of cancellation, any deposit amounts paid at the time of booking are non-refundable. 

Disputes
If you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.
